Constitutional court begins considering parliament dissolution inquiry

Moldova's Constitutional Court has started considering the inquiry on parliament dissolution circumstances, submitted to it by Acting President Mihai Ghimpu after the document had been agreed upon and signed by all members of the governing Alliance for European Integration.   

As Infotag has already reported, last Sunday the Alliance undertook an attempt to amend, by means of a constitutional referendum, the presidential election procedure in the republic to return to a direct election of the head of state because the incumbent Parliament had failed, in 2009, to elect president itself. By the law, in such situation the Parliament must be dissolved and the date of a new parliamentary election must be announced. So it will be up to the next Parliament to decide about electing president in the forum by a consensus of deputies or to vote with two-thirds of deputies for amending the presidential election procedure.    

According to the law, the Constitutional Court has 6 months at its disposal to formulate a conclusion. But this time, however, with an account of a specific situation, CC judges are going to declare their conclusion within maximum 10 days.   

If the CC rules to dissolve the Parliament, Mihai Ghimpu will be supposed to issue a corresponding presidential decree, and then to set an election date.
